BREAKING: Bannon’s Contempt Conviction ERASED After Prison Time

The Supreme Court cleared the path for the Trump administration to dismiss Steve Bannon’s criminal contempt conviction, a mostly symbolic victory for the former White House strategist who already completed his four-month prison sentence in 2024. The high court vacated an appeals court ruling that upheld Bannon’s conviction, sending the case back to a district court where prosecutors now plan to drop all charges.

Bannon Already Served His Time

Federal prosecutors convicted Bannon in 2022 on two counts of contempt of Congress after he refused to comply with subpoenas from the House committee investigating the January 6, 2021, Capitol attack. The subpoenas demanded both documents and testimony about the assault on Congress by Trump supporters. Bannon served his complete sentence last year after losing his initial appeal, and paid a $6,500 fine. The Supreme Court rejected his emergency request to avoid prison at that time.

Trump Administration Changes Course

The Trump Justice Department, which inherited the case from the Biden administration, announced in February that dismissing the prosecution serves the interests of justice. This dramatic reversal follows Trump’s return to office for his second term, during which he has systematically moved to investigate his former critics while pardoning hundreds of January 6 participants. Bannon’s legal team argued he acted in good faith by following Trump’s invocation of executive privilege, which protects certain presidential communications from disclosure.

What Happens Next

The case returns to federal district court in Washington, where government lawyers will formally move to dismiss the charges and erase Bannon’s conviction. Michael Buschbacher, representing Bannon, called the prosecution unlawful and expressed relief that the appeals court decision upholding the jury verdict has been vacated. While the outcome provides little practical benefit to Bannon, who cannot reclaim his time in federal prison, it removes a criminal conviction from his record. The decision continues a pattern of Trump administration actions favoring allies caught up in investigations related to the former president’s conduct.
