FELONY Charges Rock Federal Agent—He’s GONE…

An ICE agent faces felony assault charges after allegedly pointing his gun at two civilian drivers while on duty, exposing a legal reality most Americans never knew existed: federal agents can be prosecuted by state authorities.

When Federal Authority Meets State Law

Gregory Donnell Morgan drove an unmarked SUV through Minnesota roads on February 5, conducting his duties as an ICE agent during Operation Metro Surge. What happened next transformed a routine day into a constitutional confrontation. Two drivers called 911, reporting that someone in that SUV pointed a gun at them. Morgan now carries the distinction of being the first federal immigration officer criminally charged during Trump’s current enforcement campaign, facing two felony counts that could send him to prison for three years.

The Immunity Myth Americans Believe

Most Americans labor under a dangerous misunderstanding about federal agents. They believe these officers operate above state law, protected by an impenetrable shield of federal immunity. Hennepin County Attorney Mary Moriarty has made it her mission to shatter this myth. Federal agents do not possess absolute immunity, despite what citizens and even some law enforcement officers believe. The Supremacy Clause protects federal agents, but that protection comes with limits and requirements that few understand.

The legal reality operates far differently than public perception. State prosecutors can charge federal agents when they commit crimes. The Supremacy Clause does not hand federal agents a license to break state laws without consequences. However, these cases cannot proceed through state courts automatically. Federal courts must hear them, drawing juries from across Minnesota rather than just Hennepin County. Federal judges then determine whether immunity applies by examining whether the agent acted within their authority and job requirements.

A Fugitive Federal Agent

Morgan remains free somewhere in America, evading a nationwide arrest warrant. His whereabouts remain unknown. No defense attorney has stepped forward publicly to represent him. The federal government has issued no statement about whether they will shield one of their own or allow state prosecution to proceed. This silence speaks volumes about the unprecedented nature of this prosecution. The Trump administration’s Operation Metro Surge continues, but now its agents must confront an uncomfortable truth: state prosecutors are watching, and they are willing to act.

Constitutional Collision Course

This case represents more than one agent’s alleged misconduct. It establishes a precedent that could reshape how federal agents operate nationwide. Other state prosecutors may find courage in Moriarty’s actions, investigating federal agents who cross legal lines. The balance between federal and state authority faces a test. Federal immigration enforcement depends on agents who can act decisively, but that authority cannot extend to threatening civilians without cause. The victims who called 911 that day set in motion a legal confrontation that could reverberate for years.

The practical implications extend beyond legal theory. ICE agents working in Minnesota now understand that state prosecution remains possible if they commit crimes. This knowledge may influence how they conduct operations, potentially making them more cautious or possibly more resistant to state oversight. The deterrent effect remains uncertain, but the message rings clear: federal badges do not grant immunity from all accountability. Moriarty has drawn a line, asserting that state prosecutors retain the authority and responsibility to investigate federal agents when crimes occur, regardless of political pressure or federal objections.

  1. It is not right that officers can only ‘watch’ criminals threaten or attack them, only to get charged by a lazy, corrupt attorney who allows real criminals to go free. Moriarty chooses criminals first. That is corruption and she should face her own charges, but dems do nothing!
